lengthy and there are many pitfalls for a tenant,
even a sophisticated one, when it comes to negotiating a lease.
The rate is not the only item that will cost you money.
There are potential costs that can add to more than the SF cost
such as taxes and CAM.
The CAM can include many hidden and costly charges
depending on the type of lease (triple net, modified triple net,
or full service):
• Roof repairs
• Structural repairs
• Exterior maintenance
• Water bills
• Water pump stations
• Parking lots/Sidewalks
• Grease traps/Hood exhaust
• Advertising
• Revenue sharing thresholds
In addition, many landlords are going into bankruptcy
and banks are not extending many of the same unwritten amenities
that landlords did so it's important to document all agreements
so the receiver must honor those agreements.
Some other things the lease should contain:
• If you are in an anchored shopping center,
you want your lease tied to the anchor so if the anchor leaves,
you have the option to terminate your lease early
• If you are in a strip mall or shopping center, you want
the
right of first refusal for any adjoining space that goes vacant
• If you are in a strip mall or shopping center, you want
the right to approve the menu
of any other restaurants or have percentage of sales limits on certain
types of food served
